1. Purpose

These terms govern the wedding photography and film services offered under the trading name Dar Amore by KRAFT, a French société par actions simplifiée with share capital of €100, registered with the Marseille trade and companies register under number 108 870 973, with its registered office at 205 avenue du Prado, 13008 Marseille, France.

They apply to every order placed by a consumer, to the exclusion of any other terms.

2. Quotation and formation of the contract

Every booking is subject to a named quotation stating the date, the venue, the chosen package, any add-ons and the total price.

The quotation is valid for thirty days. The contract is formed when the signed quotation is received together with the deposit.

3. Booking and deposit

A booking becomes firm on payment of a 30% deposit of the total amount, which is set against the final price.

Sums paid constitute a deposit within the meaning of article 1587 of the French Civil Code, not earnest money: the commitment is firm for both parties. No date is held before it is received.

4. Prices and payment

Prices are stated in euros, inclusive of all taxes. The applicable price is the one on the accepted quotation, regardless of any later change to published prices.

The balance falls due on delivery of the files. Payment is made by bank transfer.

Late payment automatically incurs interest at the enhanced statutory rate, together with a fixed recovery charge of €40.

5. Travel costs

Travel is included within a 50 km radius of Marseille.

Beyond that, travel, tolls and, where the booking requires it, accommodation are itemised in the quotation. No cost is charged that did not appear on the accepted quotation.

6. Carrying out the work

The work is carried out on the dates, at the venues and at the times set out in the quotation. Clients undertake to provide access to the venues and to obtain the necessary permissions from owners or managers.

Artistic choices — framing, light, selection and editing — rest with the provider alone, within the scope of the commission.

The provider cannot be held liable for material conditions outside its control: weather, lighting imposed by the venue, delays in the schedule, or guests declining to be photographed.

7. Delivery

Photographs are delivered retouched, in high resolution, through a private online gallery, within four weeks of the wedding.

Films are delivered edited and graded, by private viewing link, within ten weeks.

These periods are given in working days and may be extended in exceptional circumstances, of which clients will be informed.

8. Cancellation by the clients

Any cancellation must be notified in writing. The deposit remains acquired by the provider.

Where cancellation occurs less than six months before the wedding date, 50% of the total amount remains due. Less than three months before, the full amount remains due.

These amounts reflect the unavailability of the date, which can no longer be offered to other clients.

9. Postponement

A booking may be postponed once, subject to the provider’s availability on the new date and within eighteen months.

The deposit is then carried over to the new date. Where the provider is not available, the cancellation terms apply.

10. Provider unable to attend

In the event of a serious impediment — illness, accident, force majeure — the provider undertakes to propose a replacement of equivalent standing, on the same financial terms.

Failing a replacement accepted by the clients, all sums paid are refunded within thirty days. That refund constitutes the only compensation due.

11. Copyright

Photographs and films remain the intellectual property of their author under French intellectual property law.

Clients receive a private usage right, free of charge and unlimited in time: printing, sharing with family and friends, publishing on their personal social media accounts.

Any commercial use, any transfer to a professional third party and any alteration of the images — cropping, filters, retouching — require the author’s prior written agreement. A credit is requested for online publication.

12. Image rights

The provider would like to be able to show a selection of images on its website, portfolio and social media. Such use is subject to separate written consent, attached to the contract.

That consent is optional: refusing it has no effect on the price or on the service. It may be withdrawn at any time, and the images concerned will then be removed from the provider’s channels within a reasonable period.

It is for the clients to inform their guests that a photographer and a filmmaker will be present.

13. File retention

The online gallery remains accessible for twelve months from delivery.

Source files are kept for twelve months, after which deletion is permanent. It is for clients to download and back up their files within that period.

14. No right of withdrawal

Under article L221-28 of the French Consumer Code, the right of withdrawal does not apply to leisure services supplied on a specific date.

Booking a wedding date falls within that exception: no withdrawal is possible after signature. The cancellation terms in article 8 apply.

15. Personal data

Data collected is processed in accordance with the site’s privacy policy, available online.

16. Complaints, mediation and governing law

Any complaint must be sent in writing to contact@kraft-creativestudio.com. The provider undertakes to reply within thirty days.

Under the French Consumer Code, clients may use a consumer mediator free of charge to seek an amicable resolution. The mediator’s details are still to be provided.

These terms are governed by French law.
